Petitioner's Points and Authorities.

The proceeding before the Court is a petition under

Section 24b of the Bankruptcy Act to revise, in mat-

ter of law, an order of the United States District

Court for the Northern District of California, First

Division, reversing in part an order and judgment

of the referee in bankruptcy, adjudging certain

personal property to be vested in the trustee of the

estate of the bankrupt.

STATEMENT OF THE CASE.

George M. Ikeda was adjudicated a bankrupt on

the 20th day of September, 1909. M. N. Williamson

was appointed receiver and subsequently elected

trustee of the estate of the bankrupt.

At the time of the adjudication the bankrupt was

engaged in the business of raising hops in the County
