Upon Writ of Error to the United States District

Court of the Eastern District of Washington,

Northern Division.

Comes now the above named plaintiff in error and

respectfully petitions the court for a rehearing of this

cause.

It is evident from the opinion filed herein that the

court has failed to take into consideration all of the

facts shown in the record, and that with reference

to some of the facts the court has misunderstood the

testimony. It is stated in the opinion that two men

were present at the time of the accident, and that they
