Upon Appeal from the United States District Court for

the Territory of Hawaii.

STATEMENT OF THE CASE.

This is an appeal on the part of the government

from a judgment of the District Court of the United

States in and for the District of Hawaii discharging

upon a writ of habeas corpus the said Tsurukichi

Nakao. The District Court of Hawaii evidently de-

termined the case upon the pleadings.
