Circuit Court of Appeals

FOR THE NINTH CIRCUIT.

THE BRIG "MERMAID", Etc.,

and SOL G. SIMPSON,

Appellants,

VS.

WILLIAM HARDY,

Appellee.

APPELLEE'S BRIEF ON APPEAL.

The statement of this ease on the part of Proctor for appel-

lant is very fair except, in three particulars :

(a) In that it fails to state that appellee signed shipping-

articles under section 4521 of R. S. of U. S. showing the nature

of the voyage in the following words:

"To ports in the District of Alaska, within the Bering Sea

and Arctic Ocean, and also other ports and places in any part

of the world, as the Master may direct, and back to a final port

of discharge in the U. S., for a term of time not exceeding six

(6) calendar months."

(b) In that it attempts to insinuate on page 3 that appel-

lee tried to bring himself within the forty-eight (48) hour
