The second amended libel alleges that on or about
September 1, 1907^ the libelant's intestate, David L.
Rainey, signed shipping articles, British form, to
serve as chief engineer of the British steamship
*' Cacique," whose registered owner was the New
York & Pacific Steamship Company, Ltd., a cor-
poration of Great Britain, on a voyage then about
to be commenced from a port on Puget Sound to
