This case is brought before this Court by writ of

error to United States District Oourt of the North-

ern District of California, Second Division, for the

purpose of reviewing an order and judgment of

non-suit entered in said action by the former United

States Circuit Court for the Ninth Circuit, North-

em District of California.

STATEMENT OF THE CASE.

The action was brought to recover from the de-

fendant the value of certain extra work done in

the construction of a bridge spanning the Stanis-

laus River between the Counties of Tuolumne and
