Circuit Court of Appeals for the Ninth Circuit:
The merits of this appeal have never been argued in
this court either on the law or the facts. It was our
impression from the argument on the motion to dis-
miss that the findings of fact made by the lower court
were to be accepted here and the brief of the govern-
ment is also written on that theory. The opinion of
this court, although setting forth some of the findings
of the lower court and ignoring others, proceeds to re-
state them in discussion in a way which shows that the
court does not accept those findings it has quoted, nor
