BRIEF FOR PLAINTIFF IN ERROR
This case has been once heard by this court on a
previous appeal, and its decision is reported in 187
Fed. Rep. 80. This report contains a full and ac-
curate statement of the facts in the case as disclosed
by plaintiff's testimony at the first trial. This evi-
dence was largely by depositions, and the same dep-
ositions were read at the second trial.
It would subserve no useful purpose to again re-
peat this evidence in extenso, which is digested on
pages 81-85 of the aforesaid volume.
