Judge, and the Associate Judges of the United
States Circuit Court of Appeals for the Ninth
Circuit:
Plaintiff in error respectfully requests a re-
hearing in this case.
This court, in its opinion affirming the judgment,
has discussed but a single phase of the case. It has
concluded "that the special verdict of the jury
finding that the Port Arthur branch of the Russo-
Chinese Bank did receive payment of the draft
dated December 11, 1903" is conclusive, and that
