This action, brought to recover damages for a
personal injury, was predicated upon the charge in
the complaint that Frank Starr, then and there be-
ing in the employ ol' The Pacific Telephone and Tele-
graph Company as an installer, was injured by the
breaking of a ladder upon which he was standing
