The undersigned, on behalf of the plaintiff in

error herein, present this petition and respectfully

request that a rehearing of the cause be granted by

this court for the following reasons :

This court erred in affirming the action of the

court below in denying the motion of plaintiff in

error for a non-suit, and erred in affirming the

action of the court below in refusing to give to the

jury a direction to return a verdict for defendant in

that court.
