Upon writ of error from the United States Dis-
trict Court for the Western District of Washington,
Southern Division,
STATEMENT OF THE CASE,
The Plaintiff in Error, Carstens Packing Com-
pany, is a corporation owning and operating a pack-
ing house in the City of Tacoma. On the 27th day
of May, 1911, and for many years prior thereto, the
Defendant in Error, Louis Godo, was in the employ
of the Plaintiff in Error as a carpenter and mill-
wright, his duties taking him all over the plant in
new construction and repair work and bringing him
constantly in the vicinity of various kinds of ma-
chinery and appliances used in that factory. Godo,
