STATEMENT OF THE CASE.

This case is before the court upon writ of error to

and upon appeal from the United States District

Court of the territory of Alaska, fourth division.

The case was submitted to the court below upon an

agreed statement of facts and a stipulation to sub-

mit the controversy without action under and pur-

suant to the provisions of Chapter 28 of the Civil

Code of Procedure of the District of Alaska. From

the agreed statement of facts appearing on pages

4 to 9, inclusive, of the transcript, it appears that

the appellant is a corporation under the laws of the

State of New Jersey carrying on a general mer-
