This is an appeal from an order granting a prelim-
inary injunction in a suit by appellee against appellant
in the Northern District of California for infringe-
ment of patent, No. 771,441, granted to Peter C.
Nielsen on October 4, 1904, for a phonograph horn.
The bill was filed November 25th, 1912, and in
addition to the usual allegations found in such bills
