STATEMENT OF THE CASE.

This is an appeal on the part of the government

from a judgment of the District Court of the United

States in and for the District of Hawaii discharging

upon a writ of habeas corpus the said Tsunezo Ku-

sano. The District Court of Hawaii evidently de-

termined the case upon the pleadings.
