PETITION FOR REHEARING.
To the Honorable the Justices of the United States
Circuit Court of Appeals for the Ninth Circuit:
The appellants respectfully petition for a rehearing
of the above entitled cause on the following grounds:
- That in the decision heretofore rendered by
Your Honors you overlooked the fact that an infringe-
ment is a tort, and the evidence must establish the
fact of the commission of such tort, and that a pre-
sumption of innocence pertains to the acts of the de-
fendants which must be overcome by proof.
As the bill charges a joint tort of all three defend-
ants the proof that there was a joint tort of two of
