POINTS AND AUTHORITIES.

The first point relied upon by appellant is that

the case must be controlled by the provisions of Sec-

tion 4527 of the Revised Statutes, re-enacted by the

act of August 18, 1890 (6 Fed. Statutes Annotated,

page 851). It seems clear to proctor for appellee

that this contention is utterly without foundation.

This legislation does not purport to take from mari-

ners, being injured or sick, their ancient remedy of
