PETITION FOR REHEARING
To the Honorable, the Judges of the Said Court :
The petition of the appellant, respectfully repre-
sents :
That in the above entitled cause, the same was ar-
gued on the 19th day of February, 1930, before Circuit
Judges Rudkin, Dietrich and Wilbur and decided
March 10th, 1930, in an opinion by Judge Dietrich in
which Judge Wilbur concurred and in which Judge
Rudkin took no part in the decision of the case, af-
firming the decree of the lower Court that the Williams
patent No. 1,219,891 was not infringed by the structure
manufactured and sold by Weber Show Case & Fix-
ture Company to said Thomas Toiven.
Your petitioner, submitting itself at all times to the
judgment of the Court, respectfully suggests, as to
certain findings of fact and certain conclusions of law
founded thereon in said opinion, which will hereafter
be specified, there is manifest error in the opinion and
decree of your Honorable Court and the same ought to
be set aside and cause reheard.
