Your petitioner, Theodore J. Geisler, an attorney of

this Court, prays leave to file a brief in this cause as

amicus curiae.

This suit involves the question of the validity and

scope of a patent. A patent, as well understood, is in

the nature of a limited monopoly, granted as a reward

for a service rendered by the inventor to the general

public, and as such deemed justifiable. (1 Rob. on Pat-

ents. Section 33.) On the other hand, a patent void, be-

cause the service for which it was granted was not per-

formed, imposes an unjust monopoly and restraint on

the public. Therefore "in administering the patent law

the Court first looks into the art to find what the real

merit of the alleged discovery or invention is", as said
