Circuit Court of Appeals for the Ninth Circuit:

Comes now the United States of America, the ap-

pellant in the above-entitled cause, and presents this,

its petition, for a rehearing of the above-entitled

cause, and in support thereof respectfully shows:

I

On October 18, 1943, this Court rendered an opinion

affirming a judgment of the District Court of the

United States for the Eastern District of Washing-

ton, Northern Division, which had been rendered on

July 6, 1942. The District Court, at the close of

plaintiff's case at trial, and on motion of the defend-

ant, had entered a judgment dismissing with prej-

udice an action for an accounting brought by the

United States of America against Pacific Fruit &

Produce Company.
