JURISDICTION
This action was commenced in the United States Dis-
trict Court by appellee's complaint (Tr. 3-11), later
amended (Tr. 12-16) against appellant and the S & M
Flying Service, a corporation, which is not a party to this
appeal. The appellant will hereafter be referred to as ''the
City". The appellee claimed that the District Court had
