OBJECTIONS TO PROPOSED FINDINGS OF
FACT, CONCLUSIONS OF LAW AND
JUDGMENT
Comes Now John K. Mesch, attorney for plaintiff,
and objects to findings of fact No. 3. Such finding
states in part as follows: "During or before the
month of September, 1960," for the reason and
upon the ground that the words '^or before" were
not a part of the Court's finding as set forth in the
transcript of such findings on July 28, 1961. The
Court's findings in such transcript is as follows:
Hit * * i^^^i J gj-j^ from the plaintiff's own testimony
that in September, 1960, he knew not only that he
had a cause of action against jMerritt, Chapman
and Scott, that he could file, and also the alternative
